Terms of service

These terms cover your use of Birthday Planner. By creating an account you agree to them. They are written to be understood rather than to be impressive.
Who can use it
You need to be 18 or over to hold an account. The service is for planning parties for your own children or children in your care. Guests responding to an invitation do not need an account and are not bound by these terms beyond not misusing the service.
Plans and billing
Free: one party per calendar year, with invitations, RSVPs and a shopping checklist.
Premium: a recurring subscription, billed in advance through Stripe. Unlimited parties, AI planning, premium invitation templates, vendor booking, shared photo albums and memory books.
Prices are shown at checkout. If we change the price of an existing subscription we will tell you before it takes effect, and you can cancel rather than accept it.
Cancelling
Cancel at any time from your account page. You keep premium until the end of the period you have already paid for, and then move to the free plan — we do not cut off access on the day you cancel.
Your data is not deleted when you cancel. Parties beyond the free limit become read-only rather than disappearing.
Refunds
If the service did not work, tell us and we will refund you. Australian Consumer Law gives you rights to a repair, replacement or refund that these terms cannot remove, and we do not try to.
Beyond that: we do not automatically refund an unused part of a period you chose to cancel in, because you had access to it. If something went wrong at your party because of us, email us — we would rather sort it out than argue about it.
Your content
The party plans, guest lists and photographs you put in are yours. You give us permission to store and display them for the purpose of running the service, and nothing else. We do not use your photographs for marketing, and we do not train models on them.
When you share an album link, anyone holding it can see and add photographs. Share it accordingly.
Photographs are deleted two years after upload. This is automatic and it applies to everyone, including paying subscribers. Download anything you want to keep before then; memory books exist for this reason.
What you must not do
- Upload photographs of children without their parents’ agreement.
- Use guest contact details for anything other than the party they responded to.
- Upload anything unlawful, or anything sexualising a child.
- Attempt to access parties or albums that are not yours.
We will close accounts that do these things, without a refund, and report the last one.
What we don't promise
We plan parties; we do not run them. The AI produces a first draft — a timeline, a budget, a menu, a shopping list — and you are the one who decides whether it is right. Check the allergy information yourself. Check quantities against your own guest list. A generated menu is a suggestion, not a safety assessment.
Weather forecasts come from a third party and are forecasts. Vendors listed in the directory are independent businesses; your arrangement is with them.
We aim to keep the service available but do not guarantee it. If it is unavailable when you needed it, our liability is limited to what you paid us in the previous twelve months, except where Australian Consumer Law says otherwise.
Changes and contact
If we change these terms materially we will email account holders before the change takes effect. These terms are governed by the law of Victoria, Australia.
